The property is currently in violation of T.C.A. 5-20-105 & 13-7-111, the Rutherford County Zoning Ordinance, and the 2018 International Residential Code.  It currently contains a Single-Family Dwelling and four (4) accessory structures.  All structures were constructed without Rutherford County Planning review and approvals, building permits obtained from Rutherford County Building Codes Department or TDEC approval/permit/inspection for  the Subsurface Sewage Disposal System (SSDS - septic system) that has been installed. All aforementioned illegal construction took place between late 2021 and late 2023 (see attached aerials).  There is no Certificate of Occupancy for the home, please advise potential buyers that a ‘Notice of Completion’ filed with the Rutherford County Register of Deeds office does not constitute a legal document verifying that the structure that has met all the minimum requirements set forth in all regulations noted above which are Tennessee State Law and applicable ordinances or regulations adopted by the Rutherford County Board of Commissioners.  It is simply a document that the owner is required to file to advise subcontractors and parties that may have filed a mechanics lien on the project that the project has come to an end.


The following items will be required to bring the property into compliance with the abovementioned law and regulations:

  • Applications for each individual structure shall be submitted to the Rutherford County Planning and Engineering Department for review of zoning, engineering, drainage requirements

  • Upon approval of such applications, all applicable impact fees will be required to be paid

  • All applicable building permits will be required to be obtained for each structure (building, plumbing, mechanical, gas, etc.)

  • An application/approval for SSDS will be required from TDEC

  • Some, or all, of the structures may be required to be evaluated by a structural engineer to verify that it has been designed and constructed in compliance with the design requirements of the 2018 IRC (where it applies to wind speed, snow load, etc.)

  • All inspections will be required to be completed, note that some finish materials may have to be removed for inspector to verify an item that may have been covered up during construction


Please note this list may not be all inclusive and may vary depending on what may be discovered during the inspection process.  Failure to complete the abovementioned items will leave Rutherford County no option but to pursue legal action to enforce.
